David Bernstein is a Partner at Resnick & Louis’ Salt Lake City office, bringing more than 20 years of high-stakes civil litigation and insurance-defense experience. Mr. Bernstein concentrates his practice on insurance defense, with particular emphasis on construction defect, product liability, premises liability, transportation, professional liability, auto liability, and complex commercial litigation. Most recently, as lead Utah attorney at a regional insurance-defense firm, he managed a docket of 50+ active matters, resolved 17 cases in his first four months through aggressive dispositive motion practice, strategic settlement negotiations, and successful mediations, and consistently delivered cost-effective outcomes for insurers and Fortune 500 companies. Throughout his career, Mr. Bernstein has litigated numerous cases in state and federal courts and tried numerous cases to verdict. He has secured a $31.7 million judgment in a commercial fraud action, obtained injunctions in high-exposure matters, successfully represented both plaintiffs and defendants in multimillion-dollar disputes, and represented Fortune 500 companies in wrongful death, product liability, and complex commercial litigation. His broad trial and appellate experience, aggressive motion practice, and careful deployment of expert witnesses enable him to secure early dismissals, favorable rulings, and advantageous resolutions for his clients.
From 2013 to 2025, Mr. Bernstein founded and operated a successful civil litigation and advisory practice before returning to the insurance-defense arena. Earlier representations include defending municipalities and corporations in civil rights, employment, personal injury, and contract actions, as well as trying complex commercial, environmental, and fraud cases.
Outside the courtroom, David is an avid skier and hiker who takes full advantage of Utah’s mountains, a PADI-certified Master Scuba Diver who enjoys exploring reefs around the world, and a dedicated family man who cherishes travel and time with his wife and son.
Mr. Bernstein received his J.D. from the University of Utah S.J. Quinney College of Law and his B.A., cum laude, in History from Bowdoin College. He is admitted to practice in Utah and before the United States District Court for the District of Utah.
